Terms of Use

1. Acceptance of These Terms

These Terms of Use (“Terms”) govern access to and use of Tidan YiPath, including its mobile application, web application, scoring services, webpages, content, and related features (collectively, the “Service”).

The Service is provided by Rockefarmer Labs Inc. (“Rockefarmer Labs,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for adults who are legally capable of entering into an agreement.

By using the Service, you represent that:

• you have the legal capacity to accept these Terms;
• you will use the Service only for lawful purposes; and
• the information you enter will not violate the rights of another person.

The Service is not directed to children.

3. Description of the Service

Tidan YiPath is an informational scoring and planning tool.

It allows users to enter selected employment, education, language, status, and regional information and receive an estimated score based on the scoring rules implemented in the Service.

The Service may also display:

• score components;
• scoring explanations;
• comparisons;
• possible score-improvement scenarios;
• rule-source information; and
• links or references to official resources.

The Service does not submit immigration applications, expressions of interest, government forms, or supporting documents on behalf of users.

4. No Government Affiliation

Tidan YiPath and Rockefarmer Labs are independent of and are not affiliated with, endorsed by, sponsored by, or acting on behalf of:

• the Government of Ontario;
• the Ontario Immigrant Nominee Program;
• Immigration, Refugees and Citizenship Canada;
• the Government of Canada; or
• any other government authority.

Government names, program names, and related references are used only to identify publicly available programs and information.

5. No Legal or Immigration Advice

The Service provides general educational and informational material only.

Nothing in the Service constitutes:

• legal advice;
• immigration advice tailored to an individual;
• representation by a lawyer;
• representation by a registered immigration consultant;
• a professional eligibility opinion;
• a guarantee of nomination, invitation, approval, status, or admission; or
• an official interpretation of any law, regulation, policy, ministerial instruction, program guide, or government decision.

Use of the Service does not create:

• a solicitor-client relationship;
• a consultant-client relationship;
• a fiduciary relationship;
• an agency relationship; or
• any other professional advisory relationship.

Users should consult official government sources and, where appropriate, a qualified lawyer or authorized immigration professional.

6. Estimates Only

Scores and calculations produced by Tidan YiPath are estimates based on:

• information entered by the user;
• the option codes available in the current version;
• scoring rules implemented by Rockefarmer Labs; and
• our interpretation of publicly available information.

An estimated score may differ from:

• a score calculated by a government authority;
• a score shown in an official government portal;
• a future score following a rule change;
• an invitation threshold;
• an eligibility determination; or
• the outcome of an application.

A high estimated score does not guarantee eligibility, an invitation, nomination, approval, permanent residence, or any other immigration outcome.

A low estimated score does not necessarily mean that a user is ineligible or will not receive an invitation.

7. Changing Rules and Information

Immigration laws, program criteria, scoring rules, occupation classifications, regional definitions, eligibility requirements, application procedures, invitation thresholds, and government policies may change at any time.

The Service may not reflect a change immediately.

The date of a rule source, application version, or content update does not guarantee that every part of the Service is current.

Where information in Tidan YiPath conflicts with an official government source, the official source controls.

8. User Responsibilities

You are responsible for:

• entering accurate and complete information;
• selecting the option that best reflects your actual circumstances;
• reviewing the score breakdown;
• confirming current rules with official sources;
• obtaining professional advice where appropriate;
• meeting government deadlines;
• preparing and submitting your own applications and documents; and
• making your own legal, immigration, employment, education, and financial decisions.

You should not enter another person’s information without appropriate authority.

You should not enter unnecessary identity documents, account credentials, passwords, government identification numbers, or other information not requested by the Service.

9. No User Account or Saved Application

The current version of Tidan YiPath does not create a government account, immigration file, application record, or persistent user profile.

Closing the Service, changing devices, clearing browser data, or updating the application may cause unsaved inputs or results to be lost.

Users are responsible for retaining any information they wish to keep.

10. Permitted Use

Subject to these Terms, Rockefarmer Labs grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to use the Service for personal informational and planning purposes.

You may not:

• use the Service for unlawful, fraudulent, deceptive, or abusive purposes;
• misrepresent the Service as an official government service;
• impersonate Rockefarmer Labs or a government authority;
• interfere with the operation or security of the Service;
• attempt to gain unauthorized access to systems, data, or accounts;
• introduce malware or harmful code;
• overload, scrape, probe, or automate access in a manner that harms the Service;
• bypass rate limits, access controls, or security measures;
• reproduce or commercially redistribute substantial parts of the Service without permission;
• reverse engineer the Service except where applicable law expressly permits it; or
• use the Service to violate the rights of Rockefarmer Labs or another person.

11. Intellectual Property

The Service, including its software, interface, branding, graphics, documentation, selection and arrangement of content, and original explanatory material, is owned by Rockefarmer Labs or its licensors and is protected by applicable intellectual-property laws.

These Terms do not transfer ownership of the Service or any intellectual-property rights to you.

Government publications, program names, laws, regulations, and other public materials remain the property of their respective owners or are subject to their applicable terms of use.

“Tidan YiPath,” “Rockefarmer Labs,” associated logos, and related branding may not be used in a manner that suggests affiliation, approval, or endorsement without written permission.

12. Third-Party Services and Links

The Service may contain links or references to third-party websites, government resources, app stores, or other services.

Rockefarmer Labs does not control and is not responsible for:

• third-party content;
• third-party privacy or security practices;
• the accuracy or availability of third-party services;
• changes made by third parties; or
• transactions between a user and a third party.

A link does not constitute endorsement unless expressly stated.

13. Public Beta and Service Availability

Tidan YiPath v0.3 may be offered as a Public Beta.

Beta software may contain:

• errors;
• incomplete features;
• calculation defects;
• compatibility limitations;
• service interruptions; or
• content that requires correction.

We may, at any time and without guaranteeing prior notice:

• modify the Service;
• correct or remove content;
• change scoring implementations;
• limit access;
• suspend features;
• discontinue the beta;
• introduce usage limits; or
• stop operating all or part of the Service.

We do not guarantee that the Service will always be available, uninterrupted, secure, or compatible with every device or browser.

14. Privacy

Our collection and handling of information are described in the Tidan YiPath Privacy Policy.

By using the Service, you acknowledge that scoring inputs may be transmitted to a remote server for processing as described in that policy.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

Rockefarmer Labs disclaims all representations, warranties, and conditions, whether express, implied, statutory, or collateral, including warranties or conditions of:

• accuracy;
• completeness;
• currency;
• merchantability;
• fitness for a particular purpose;
• non-infringement;
• uninterrupted availability;
• error-free operation;
• security; and
• suitability for an immigration or legal decision.

We do not warrant that:

• a score is official;
• a calculation is free from error;
• the Service reflects the latest government rule;
• a user qualifies for a program;
• a user will receive an invitation or nomination; or
• a government authority will accept any interpretation shown by the Service.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Rockefarmer Labs and its directors, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of:

• opportunity;
• immigration status;
• application fees;
• income;
• employment;
• business;
• data;
• reputation;
• anticipated savings; or
• profits,

arising from or relating to the Service, even if advised that such loss may occur.

Rockefarmer Labs is not responsible for decisions made by:

• users;
• government authorities;
• employers;
• educational institutions;
• professional advisers; or
• other third parties.

To the maximum extent permitted by law, Rockefarmer Labs’ aggregate liability arising from or relating to the Service will not exceed the greater of:

• the amount, if any, paid by the user to Rockefarmer Labs for the Service during the twelve months preceding the claim; and
• CAD $50.

These limitations do not apply to liability that cannot lawfully be limited or excluded.

17. Indemnification for Misuse

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or expenses reasonably arising from:

• your unlawful use of the Service;
• your material violation of these Terms;
• your infringement of another person’s rights; or
• your attempt to represent the Service as an official or authorized government product.

This section does not require a consumer to indemnify Rockefarmer Labs for losses caused by Rockefarmer Labs’ own unlawful conduct, gross negligence, or wilful misconduct.

18. Suspension or Termination

We may suspend or terminate access to the Service where reasonably necessary to:

• prevent abuse;
• protect security;
• comply with law;
• protect users or third parties;
• investigate suspected misconduct; or
• discontinue the Service.

Sections that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, liability limitations, and governing law.

19. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.

Subject to any mandatory consumer rights or jurisdictional protections that apply to you, disputes relating to these Terms or the Service will be submitted to the courts of Ontario, Canada.

20. Changes to These Terms

We may update these Terms to reflect changes to:

• the Service;
• scoring functionality;
• legal requirements;
• business practices; or
• security and operational needs.

The updated Terms will display a revised “Last Updated” date.

Where reasonably appropriate, material changes may also be communicated through the Service. Continued use after updated Terms take effect constitutes acceptance of those Terms to the extent permitted by law.

21. Severability and Entire Agreement

If a provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Terms, together with the Privacy Policy and Disclaimer, form the agreement between you and Rockefarmer Labs regarding use of the Service, except where additional written terms expressly apply.
